Privacy Policy

1. Information we collect

Information you provide

When you subscribe, we collect your email address. If you contact us, we collect the information included in your message and any information you choose to provide.

Signup and newsletter information

We collect subscription status, signup date, referring site, campaign-attribution values included in a signup URL (such as UTM source, medium, campaign, term, and content), and a randomly generated signup event identifier. Beehiiv may also provide newsletter delivery and engagement information, such as whether an email was delivered, opened, or clicked.

Technical information

Our hosting and infrastructure providers may automatically process information such as IP address, browser and device type, operating system, requested pages, referring URL, and request date and time. This information is used to deliver and secure the site and to diagnose technical problems.

Device storage and third-party media

If you use KMARK Radio, the site stores a functional preference namedkmark-radio-player-state in your browser’s local storage so the player can remember whether it is open or minimized. When you choose to load the Spotify player, Spotify may receive technical and usage information and may use cookies or similar technologies under its own policy.

Advertising and conversion information

If you allow optional advertising measurement, the Meta Pixel may process page URLs, referrers, campaign parameters, event names and timestamps, event identifiers, browser or device identifiers, cookies, IP address, user agent, and actions such as page views and successful newsletter signups. Meta may combine this information with information it already holds under its own policies. KMARK 101 does not currently send hashed email addresses or server-side events to Meta.

2. How we use information

We use information to:

• provide, operate, and maintain the website and newsletter;
• create and manage subscriptions and honor unsubscribe requests;
• attribute signups to campaigns and understand acquisition performance;
• measure advertising, deduplicate browser and server events, and understand conversions;
• create, refine, or suppress advertising audiences where permitted;
• deliver KMARK Radio and remember functional player preferences;
• respond to messages and privacy requests;
• protect the site, subscribers, and services from fraud, abuse, and security threats;
• debug, maintain, and improve site performance; and
• comply with law and enforce our rights.

3. How we disclose information

We disclose information only as reasonably necessary for the purposes described in this policy:

• Beehiiv. Beehiiv processes subscriber information, signup attribution, newsletter delivery, subscription status, and email engagement on our behalf. Read the Beehiiv Privacy Policy.
• Vercel. Vercel hosts the website and may process request, device, security, and diagnostic information to provide the service. Read the Vercel Privacy Notice.
• Spotify. Spotify receives information directly from your browser only when its player or links are loaded or used. Spotify acts under its own policy. Read the Spotify Privacy Policy.
• Meta and other advertising or measurement partners. If you allow optional advertising measurement, the Meta Pixel discloses the advertising and conversion information described in Section 1 to measure campaign-attributed page views and successful newsletter signups. Meta processes information under its own policies. Read the Meta Privacy Policy.
• Legal and safety disclosures. We may disclose information if reasonably necessary to comply with law, legal process, or a valid government request; enforce agreements; investigate fraud or abuse; or protect the rights, safety, and security of KMARK 101, subscribers, visitors, or others.
• Business transfers. Information may be disclosed as part of a merger, financing, reorganization, sale of assets, or similar transaction, subject to appropriate confidentiality and legal requirements.

KMARK 101 does not sell personal information for money and does not offer a financial incentive for personal information. Disclosures through the Meta Pixel may be considered “sharing,” targeted advertising, or a “sale” under broadly written state privacy laws. We provide and honor the applicable consent and opt-out choices.

4. Cookies, local storage, and tracking

KMARK 101 uses browser local storage to remember the KMARK Radio player state and your optional tracking preference. The Spotify player may use its own cookies or similar technologies when you choose to load it.

If you select “Allow” in the tracking-preference control, KMARK 101 loads the Meta Pixel. The Pixel may set or read identifiers such as the _fbp cookie and sends PageView events as you browse. After Beehiiv confirms a successful newsletter signup, it also sends a Lead event. If you decline, the Meta script does not load and those events are not sent. Declining will not prevent access to the site or the newsletter signup flow. Meta Conversions API and server-side Meta events are not active.

We do not separately respond to legacy browser “Do Not Track” signals. We treat an enabled Global Privacy Control signal as a decline of optional advertising measurement and as an opt-out of sale, sharing, or targeted advertising to the extent required by applicable law.

5. Your choices and privacy rights

• Email choices: You can unsubscribe using the link in any KMARK 101 newsletter. We may keep a limited suppression record so we can honor that choice.
• Local storage: You can clear local storage through your browser. Doing so may reset the radio player’s saved state.
• Privacy requests: Depending on where you live and applicable law, you may request access to, correction of, deletion of, or a portable copy of personal information, or object to or restrict certain processing.
• Advertising choices: Use the site’s tracking-preference control to allow or decline optional Meta measurement. You can change a saved choice by clearing the site’s local storage and reloading the page. We also honor Global Privacy Control as described above and requests to opt out of sale, sharing, or targeted advertising where required by law.

Submit requests to markfriedman92@gmail.com. We may ask for information reasonably necessary to verify your identity and request. Authorized agents may submit a request where permitted by law, but we may require proof of authority and verification of the consumer. We will not discriminate against you for exercising applicable privacy rights.

6. Retention and security

We retain information for as long as reasonably necessary to provide the newsletter and website, maintain subscription and suppression records, fulfill the purposes described above, resolve disputes, protect the service, and satisfy legal obligations. Retention periods vary by the type of information and the systems used. Service providers may retain backup, security, or transaction records under their own schedules and contractual obligations.

We use reasonable administrative and technical safeguards appropriate to the information we process. No online transmission or storage system can be guaranteed completely secure, so we cannot promise absolute security.

7. Children’s privacy

KMARK 101 is a general-audience service and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 provided personal information, contact us so we can investigate and delete it as appropriate.

8. California privacy notice

This section supplements the policy for California residents. In the preceding 12 months, KMARK 101 has collected the following general categories of personal information: identifiers such as email address, IP address, and signup event identifier; internet or electronic activity such as request information, referral and campaign attribution, and newsletter delivery or engagement; and correspondence you send to us.

We collect these categories directly from you, from your browser or device, from signup URLs and referring pages, and from service providers. We use and disclose them for the business purposes described in Sections 2 and 3. The service-provider categories are email and newsletter platforms, hosting and infrastructure providers, and—when you choose to use it—third-party media providers. We do not intentionally collect sensitive personal information through the public website.

KMARK 101 has not sold personal information for money in the preceding 12 months. When a visitor allows the Meta Pixel, identifiers and internet or electronic activity may be disclosed to Meta for advertising measurement; applicable law may define that disclosure as sharing, targeted advertising, or a sale. We do not knowingly sell or share personal information of anyone under 16. California residents may request to know, access, correct, or delete covered personal information, subject to legal exceptions, and may opt out of covered sharing or targeted advertising without discriminatory treatment. Instructions for making and verifying a request appear in Section 5.

9. Changes to this policy

We may update this policy to reflect changes in the site, service providers, or legal requirements. We will post the updated policy here and revise the date above. If a change materially affects how we use personal information, we will provide additional notice when appropriate, such as a prominent site notice or an email to subscribers.
